Identity, refunds & unfiled returns

CP59 notice — Don't let this one sit

The IRS has no record of your tax return for the year named, and it wants one — or your explanation of why you weren't required to file. The nonfiler program restarted at scale: over two million of these went out in FY2025.

Don't sit on it

What this letter is

The IRS has no record of your tax return for the year named, and it wants one — or your explanation of why you weren't required to file. The nonfiler program restarted at scale: over two million of these went out in FY2025.

Why you got it: Income was reported under your SSN (a W-2, 1099s, platform records) but no return arrived — or your return was never received/processed.

What it is not

Not a bill — yet. But if the IRS decides you owed and never filed, it can build a return for you (a 'substitute for return') with none of your deductions argued, and the clock to claim any refund you were owed is quietly running out (generally 3 years from the filing deadline).

Your first move: Decide which of the three truths is yours: (1) you filed — send a signed copy with proof of filing; (2) you didn't file and should have — file now; (3) you weren't required to — reply with the explanation on Form 15103.

Your deadline, counted

The clock on this letter: File or respond by the date on the notice — immediately is the IRS's word.

The notice's own date controls. The hidden clock: refunds are generally lost 3 years after the return's due date (26 U.S.C. 6511), and there is no time limit at all on the IRS assessing tax for a year never filed (6501(c)(3)).

Your options, in the order most people should try them

1. File the return

The complete fix. If a refund is due and the 3 years haven't run, you still get it.

2. Prove you filed

Signed copy + e-file acceptance or certified-mail receipt.

3. Explain in writing

Form 15103 with your income facts if no filing was required.

Your rights on this letter

  • File the real return at any time — a correct return replaces a substitute one.
  • Explain non-filing on Form 15103 if you weren't required to file.

How to respond

Mail or fax the return/Form 15103 as the notice directs; the notice can also be answered through your online account's mobile forms.

Scam check

A CP59 never asks for payment. Anyone who 'found your unfiled return' and wants money by phone is running a script.

If you ignore it

Reminders escalate (CP516, then CP518), and the IRS can prepare a substitute return from third-party data — no dependents argued, no credits claimed, worst filing status — then bill you for it.

Where this sits on the ladder: CP518 → CP2566 →
